However, the Tribunal had to render more than twenty-four decisions during the proceedings, manage an exceptionally cumbersome file and deal with a conflict that stretched over more than two years. <\/p>\n<p>The contrast is striking. For the Court, there is only one explanation: the procedural strategy of a party, who used the judicial system excessively and unreasonably. <\/p>\n<h2>A formal recognition of judicial violence<\/h2>\n<p>The major contribution of the judgment lies in the clear qualification of a phenomenon that practitioners have been observing for a long time. The Tribunal does not limit itself to talking about abuse of process: it identifies a broader dynamic, that of judicial violence, which it describes as: <\/p>\n<blockquote>\n<p>\u201cthe use of the judicial process to harm, maintain control or financially exhaust the other party\u201d.<\/p>\n<\/blockquote>\n<p>This definition finally provides a structured legal framework for a reality that is often difficult to name. The judgment also lists several indicators that make it possible to recognize this form of violence: <\/p>\n<ul>\n<li>Multiplication of unfounded or dilatory requests<\/li>\n<li>Procedural harassment without valid justification<\/li>\n<li>repeated non-compliance with orders<\/li>\n<li>Concealment of essential information, including financial information<\/li>\n<li>excessive judicialization of each stage of the case<\/li>\n<\/ul>\n<p>In this case, the Court concluded that these behaviours went far beyond the usual tensions of a family dispute and constituted a clear abuse that was part of a dynamic of judicial violence.<\/p>\n<h2>Concrete effects on the outcome of the dispute<\/h2>\n<p>The other striking element of the judgment is that judicial violence is not limited to a procedural sanction. It has a direct bearing on the findings of the Tribunal. <\/p>\n<p>Thus, the misconduct had an impact on:<\/p>\n<ul>\n<li>the division of the family patrimony, where the principle of equality has been set aside<\/li>\n<li>Analysis of financial evidence<\/li>\n<li>Imputation of income<\/li>\n<li>the granting of monetary sentences<\/li>\n<\/ul>\n<p>The Tribunal also notes that abuse of process may open the door to:<\/p>\n<ul>\n<li>compensatory damages<\/li>\n<li>moral damages<\/li>\n<li>Punitive damages<\/li>\n<\/ul>\n<p>Judicial violence thus becomes a real basis for civil liability in a matrimonial context.<\/p>\n<h2>A strong message sent by the courts<\/h2>\n<p>This decision is part of a broader development: the recognition that violence in the family context can also be carried out through the justice system itself.
