{"id":14361,"date":"2013-08-16T14:32:20","date_gmt":"2013-08-16T14:32:20","guid":{"rendered":"http:\/\/clients-conceptsk9.com\/azran-dev\/uncategorized\/le-fonds-de-prevoyance-en-copropriete-au-quebec\/"},"modified":"2025-01-15T10:06:38","modified_gmt":"2025-01-15T15:06:38","slug":"the-contingency-fund-in-co-ownership-in-quebec","status":"publish","type":"post","link":"https:\/\/azran.ca\/en\/the-contingency-fund-in-co-ownership-in-quebec\/","title":{"rendered":"The Contingency Fund in Co-ownership in Quebec"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column][vc_column_text css=&#8221;&#8221;]The payment of common expenses (or condo fees) is probably the most well-known obligation on the part of a co-owner.<br \/>\nWhen visiting a condo for sale, one of the main questions for potential buyers is how much will have to be paid monthly for the payment of common expenses.<br \/>\nIndeed, no one wants to pay a high amount and a building with low condo fees is often given increased importance.<br \/>\nBut it is often in these cases that the contingency fund is insufficient.<br \/>\nUsually, this perception of co-ownership does not reflect the building&#8217;s administration that is intended to be sound and efficient. <!--more--><\/p>\n<div class=\"boitegrise\">\n<p>Under article 1064 of the <em>Civil Code of Qu\u00e9bec<\/em>, the basic principle is established to the effect that:<\/p>\n<blockquote>\n<p>&#8221; <em>each of the co-owners contributes, in proportion to the relative value of his fraction, to the expenses <\/em><em>resulting from the co-ownership and the operation of the immovable, as well as to the contingency fund established pursuant to article 1071 (&#8230;<\/em> )&#8221;.<\/p>\n<\/blockquote>\n<p>Thus, it is precisely article 1071 of the <em>Civil Code of Quebec<\/em> that stipulates that:<\/p>\n<blockquote>\n<p>\u00ab <em>The syndicate establishes, based on the estimated cost of major repairs and the cost of replacing the common elements, a contingency fund, liquid and available in the short term, allocated solely to these repairs and replacements.<br \/>\nThis fund is the property of the syndicate <\/em> \u00bb.<\/p>\n<\/blockquote>\n<p>Finally, article 1072 of the <em>Civil Code of Qu\u00e9bec<\/em> indicates how the contribution to common expenses is established:<\/p>\n<blockquote>\n<p>\u00ab <em>Each year, the board of directors determines, after consulting the meeting of co-owners, the contribution of the co-owners to the common expenses, after determining the sums necessary to meet the expenses arising from the co-ownership and the operation of the immovable and the sums to be paid into the contingency fund.<br \/>\nThe co-owners&#8217; contribution to the contingency fund is at least 5 per cent.<br \/>\n100 (5%) of their contribution to common expenses.<br \/>\nTo establish this, account may be taken of the respective rights of the co-owners on the common areas for restricted use (&#8230;) <\/em> \u00bb.<\/p>\n<\/blockquote>\n<\/div>\n<div class=\"boitegrise\">\n<p>By reading these three (3) articles, we can see that common expenses can be divided in two ways: common expenses for daily expenses, and those related to major repairs and the replacement cost of common portions that will be deposited in the contingency fund.<br \/>\nThe<strong> sums <a href=\"https:\/\/planibatimat.ca\/en\/contingency-fund-study\/\">in the contingency fund<\/a><\/strong> cannot therefore be used for anything other than what is provided for in the law.<br \/>\nThus, it is forbidden to draw from this account to:<\/p>\n<ul>\n<li>pay a supplier who has provided services to the condominium,<\/li>\n<li>pay professional fees owed to a lawyer or notary,<\/li>\n<li>to pay for anything related to the day-to-day management of the condominium.<\/li>\n<\/ul>\n<\/div>\n<div class=\"boitegrise\">If an unforeseen expense turns out to be too high to be paid from the current account, the directors will have to ask for a special contribution from all the co-owners in order to compensate for the lack of money.<br \/>\nAnother behaviour often observed in buildings held in divided co-ownership is to limit themselves to the minimum percentage provided for by law for the contribution to the contingency fund.<br \/>\nThus, the directors are satisfied with asking for five percent (5%) of the contributions to common expenses and thus consider themselves satisfied with compliance with Article 1072.<\/div>\n<div class=\"boitegrise\">In accordance with section 1071, the union must establish this fund based on the estimated cost of major repairs and the cost of replacing the common elements.<br \/>\nThe best way to proceed is for the Syndicate to establish a maintenance logbook where, with the help of a professional, a list of the common portions of the building and their approximate lifespan can be established.<\/div>\n<div class=\"boitegrise\">For example, if it is determined by an engineer that the roof has a lifespan of 10 years and that its replacement cost is estimated at $20,000, the Syndicate may set an annual contribution of $2,000.00 for the next ten years for this specific element, which will ensure that the required funds are available at the time of the corrective work.<br \/>\nHe will be able to do the same for each of the common areas.<br \/>\nThis way of proceeding will make it possible to realize that the legal minimum percentage is often insufficient to ensure the sustainability of the building.<\/div>\n<div class=\"boitegrise\">Therefore, it is important to ensure that the contingency fund is properly replenished at all times.<br \/>\nThe amounts deposited will be used to ensure that when the time comes, major repairs to the common elements can be made without having to ask for a special assessment from the co-owners.<br \/>\nFuture condo buyers should be aware that high common charges related to the desired private portions may be a good positive indication.<br \/>\nThe one that shows that the contingency fund is being seriously maintained, all subject to the necessary checks.<\/div>\n<div class=\"boitegrise\">Karl De Grandpr\u00e9 Azran Lawyers<\/div>\n<p>[\/vc_column_text][\/vc_column][\/vc_row]<\/p>\n<div style='text-align:center' class='yasr-auto-insert-visitor'><\/div><\/div>","protected":false},"excerpt":{"rendered":"<p>[vc_row][vc_column][vc_column_text css=&#8221;&#8221;]The payment of common expenses (or condo fees) is probably the most well-known obligation on the part of a co-owner.
